FAQ
The 6 questions most often asked before hiring a headhunter, with answers citing regulations or official sources.
Do I have to pay to use a headhunter?
By law, for-profit employment service institutions may charge domestic job seekers, but there are caps: the registration fee and referral fee combined may not exceed 5% of the first month's salary, the employment counseling fee may not exceed NT$1,000 per hour, and each vocational psychological test may not exceed NT$700 (Article 4 of the Standards for Fee Items and Amounts Charged by Private Employment Service Institutions). In practice, many headhunting firms do not charge job seekers; for example, Accurate's fee schedule states that job seekers are not charged. Operators must post the schedule of fee items and amounts at their place of business, and charging fees beyond the standards is illegal (Article 40, Paragraph 1, Subparagraph 5 of the Employment Service Act); before being asked to pay, you can first ask them to show the schedule.

A job bank is a platform for posting jobs and resumes, where companies mostly post jobs themselves and job seekers apply themselves; a headhunter is a consultant commissioned by a company to proactively find people. Taking 104 Headhunter as an example, the process described in the report is case opening and industry survey, candidate search, consultant interview, writing a recommendation letter, then arranging company interviews, generally taking about 2 to 3 weeks. Headhunters are often used for mid- to senior-level, confidential or hard-to-fill positions, and the fee is usually paid by the commissioning company.
Source: https://www.businesstoday.com.tw/article/category/183034/post/202509180046/、https://blog.104.com.tw/how-much-headhunter-cost/How do I choose a reliable headhunting firm?
First confirm that the firm has an employment service permit: a private employment service institution must obtain permission from the competent authority to operate (Article 34 of the Employment Service Act), and you can check against the directory of private employment service institutions published by the Ministry of Labor. A legitimate operator must post its permit, the schedule of fee items and amounts, and the employment service professional certificates at its place of business (Article 28 of the Regulations for the Permission and Administration of Private Employment Service Institutions), and must also sign a written contract when handling placement (Article 40, Paragraph 1, Subparagraph 1 of the Employment Service Act). Then look at whether its strengths in industries and seniority match your needs, and whether the consultant can clearly explain the job content, salary and working hours (Article 29 of the same Regulations).

Statutory cap: where an employee's first-month salary is at or below the average salary, the registration fee and referral fee combined may not exceed one month's salary; where it is above the average salary, they may not exceed four months' salary (Article 3 of the Standards for Fee Items and Amounts Charged by Private Employment Service Institutions). The referral fee may be collected only after the employment contract takes effect; if the contract is terminated within 40 days of taking effect for reasons attributable to the job seeker, the employer may request one free re-referral or a refund of 50% of the referral fee (Article 4 of the Regulations for the Permission and Administration of Private Employment Service Institutions). In market practice, an article by a 104 Headhunter manager says most firms charge only after the candidate starts work, calculated on annual salary, with a rate of roughly 20%-30%, and the higher the annual salary the higher the rate.

Article 9 of the Employment Service Act provides that employment service institutions and their personnel may not disclose job seekers' information to the public, except as necessary for referral to employment. Operators' practices mostly also state that your consent is required before your resume is sent; for example, Accurate explains that it only sends your resume to companies you have agreed to. It is advisable to tell your consultant at the start which companies (including your current employer and affiliated companies) should not be approached, and to confirm the company name before each submission.
Source: https://law.moj.gov.tw/LawClass/LawAll.aspx?pcode=N0090001、https://headhunt.com.tw/Pages/AboutUs.htmlHow do I choose between a foreign headhunting firm and a local one?
Look at where the target position is and what kind of network you need. The strength of foreign headhunting firms is their cross-border networks; for example, Michael Page's website claims 34 countries and more than 100 offices, and Robert Walters can work with its mainland China and Hong Kong offices on Greater China recruitment, which suits positions at foreign or multinational companies. Local headhunting firms are mostly familiar with Taiwan's industries; for example, Accurate's service industries cover semiconductors, optoelectronics and traditional industries, and Step1ne has a construction engineering / BIM section. Whichever you choose, first confirm the permit and fee schedule, and then look at whether the consultant knows your target industry well.
